Are Warrants Public Information in South Dakota?

Under that law, arrest warrants and bench warrants are generally accessible to the public once issued. Bench warrants in South Dakota carry an unusual statutory detail — under SDCL § 23A-39-4, the clerk of courts may assess a $10 cost against the defendant simply for issuing one, a provision that has been on the books since 1987.
The exemptions, however, are spelled out in SDCL § 1-27-1.5 and they are extensive. Subdivision (5) shields records developed or received by law enforcement agencies "if the records constitute a part of the examination, investigation, intelligence information, citizen complaint or inquiry, informant identification, or strategic or tactical information." This language gives agencies considerable discretion to withhold warrant-related materials tied to open investigations. Search warrant affidavits carry their own sealing mechanism under SDCL § 23A-35-4.1, which allows a court to seal the supporting affidavit until an investigation ends or charges are filed — though the statute expressly prohibits sealing the warrant itself, its return, or the inventory of seized property.
So while the law tilts toward disclosure, active investigative warrants and sealed-case materials routinely remain out of public view until a prosecution moves forward or a case concludes.
